Enforcement & Visitation
Certain types of Court Orders are enforceable by contempt. An Order to pay child support or maintenance is enforceable by the threat or imposition of a jail sentence and fine. If you have an Order awarding you child support or maintenance, you have a right to be paid. Greg Gegenheimer will be a forceful advocate for you in enforcing your rights under an Order. Sometimes, non-paying spouses sneer "I can't pay if they put me in jail". Well, if they are not paying anyway, they might as well be in jail. Usually, they find a way to pay.

Sometimes, a person ordered to pay child support or maintenance cannot pay for legitimate reasons. There are valid statutory defenses for not obeying a Court Order to pay support. There are also a variety of ways to make compromises and settlements that permit a delinquent parent to avoid a finding of contempt or jail sentence. Each individual case is different, and Greg Gegenheimer takes the time to explore your individual situation to determine the most appropriate way to defend a motion to enforce support.

A parent who has court ordered visitation or access to his or her child has a right to enforce that order and should not be subject to the whims and caprices of the custodial parent. If you are a parent with the right to see your child, and the other parent interferes with or ignores that right, the law provides you with a means to enforce that right through court action. Your child needs to see you and to have you in his or her life, and the other parent has no right to exclude you and interfere with your relationship with your child. A parent who interferes with court ordered visitation may be found in contempt and sentenced to jail for failure to obey the order and may be ordered to provide makeup visitation for the time wrongfully withheld. Texas Courts are serious about enforcing visitation rights and Greg Gegenheimer can be a powerful advocate in ensuring that you have the ability to maintain a relationship with your child.
